Tropical Chasers, Inc. d/b/a Weather Champs (“Weather Champs”, “we”, “us”, “our”) is committed to protecting your privacy. This privacy policy (this “Policy”) explains how we collect, protect, use, and share information we collect about you when you use our mobile app (“App”) or access our website, https://www.weatherchamps.app, (“Website”). At this time, our App and Website, and thus also this privacy policy, are only targeted at users in the United States.‍

 

Information Collected

 

Information You Provide

In order to create an account as a user of our App, you must provide us:

  • Your email address;

  • A username; and

  • A password

 

If you purchase a subscription plan you also will be required to provide us:

  • Your full name

 

In addition to the above, if you so choose, you may provide us:

  • Your photo for use in your user profile (to do this, you may allow us to access your phone’s camera or photo album);

  • Your payment card or other financial information (if you purchase the subscription version of the App or make in-app purchases);

  • Information you provide in the course of making purchases, entering contests, or completing surveys;

  • Information from your linked accounts or social media profiles, if you choose to sign up for our App through your Facebook, Google, Apple or other account.

  • Any other information you provide in a communication with our customer support team.

 

On our Website or within our app, if you choose, you may provide the following personal information:

  • Your full name;

  • Your address;

  • Your phone number;

  • Year of Birth

 

Information Generated When You Use Our Services

We also collect usage and device information as you use our Website and App.

 

During your visit to our Website, we may capture your browser type, device information, and IP address in order to monitor the way you interact with the Website and compile aggregated statistics. Our Website also uses cookies (see the Cookies & Tracking Technologies section below for further information).

 

As you use our App, we may collect information about your activity (e.g., when you log in, the features you use, and the ads with which you interact). We also may collect information about the device you use to access the App including device ID and type and your app settings.

 

If you give us permission, we can also collect your precise geolocation.

 

Information Use

 

Our main purpose for collecting information about you is to provide you with our services.

 

Additionally, Weather Champs may use the information we collect about you, including personal information, for the following purposes:

  • To create and manage your account;

  • To provide you with customer support;

  • To communicate with you and respond to your inquiries;

  • To provide information you have requested;

  • To provide information or advertisements that may be of interest to you;

  • To administer and improve our App and Website;

  • To develop new features and services;

  • To generate statistics and de-identified data;

  • To prevent, detect or fight fraud or illegal activities;

  • To comply with legal requirements; and

  • For any other purpose with your consent.

 

Information Disclosure or Sale

 

  • When you play our weather games, your username, photo or avatar, and score are displayed to other forecasters (users) playing the game.

 

  • We may disclose your information, including personal information, to our third-party advertising and contest partners so that they may display advertisements in our App that are relevant to you, administer coupons or other discounts being offered or facilitate your participation in contests. We may also disclose your information to disaster relief partners. These disclosures may be considered a sale of data by certain data privacy laws.

 

  • We may disclose the information we collect about you, including personal information, to our service providers to help us operate and improve our services. For example, we disclose information to third party data analytics providers who help us understand and track the use of our App and Website.

 

  • We also may disclose information to our affiliates; as required by law or law enforcement; or in the event of a corporate transaction such as a merger, sale, or acquisition.  

 

Cookies & Tracking Technologies

We use cookies and similar tracking technologies to track the activity on our Website. Cookies are files with a small amount of data which may include a unique identifier. Cookies are sent to your browser from a Website and stored on your device. We may also use other tracking technologies such as beacons, tags and scripts to collect and track information and to improve and analyze our website.

 

Our Website uses third parties to assist us in analyzing data regarding visitors to our Website. For example, we use Google Analytics and Twitter Pixel. Google Analytics uses cookies to collect information about, for example, the number of visitors to a site, the webpage that referred visitors to a site, and the pages that visitors view within a site. You can opt-out of Google Analytics by downloading Google’s Opt-Out Browser Add-on. Twitter Pixel uses cookies and code to collect performance analytics about our Website. You can adjust the advertising settings in your Twitter account at https://help.twitter.com/en/personalization-data-settings.

 

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Website. Additionally, some internet browsers have “Do Not Track” or “DNT” features which, when turned on, send a signal to the website that the individual visiting the website does not wish to be tracked. Our Website does not currently respond to DNT signals, but you may adjust your cookie settings in your browser.

Data Security

We have put in place technical, administrative, and physical security measures that are designed to help protect information we collect and process from unauthorized access, disclosure, or destruction.

 

Third Party Links

Our App and Website may maintain links to other websites, including social media sites. Weather Champs exercises no control over such other websites or their privacy practices, and this Policy does not apply to information collected through such websites. We recommend that you review the privacy policy of any website you visit to determine how the operator handles personal information collected through its website.

 

Data About Children

Our App and Website are not directed at individuals under the age of eighteen (18), and we do not knowingly collect personal information from minors under the age of eighteen (18). In order to create an account on our platform, users must be at least eighteen (18) years of age.

 

Changes To This Notice

We may revise this Policy from time to time. When we make changes to this Policy, we will post the updated version on our Website and App and indicate the date the Policy was last updated. If our privacy practices change in a way that significantly affects how we handle personal information, we will not use the personal information we previously gathered in the manner described in the updated policy without providing notice and/or obtaining your consent, as appropriate. Please review this Policy periodically to check for any updates. Your continued use of our services indicates your consent to the terms of this Policy.

 

California Residents: Your Rights

California residents (“you” or “your” for purposes of this “California Residents: Your Rights” section) have specific rights regarding your personal information under the California Consumer Privacy Act (“CCPA”) as amended by the California Privacy Rights Act (“CPRA”) (collectively referred to herein as the “CPRA”). This section supplements the information contained in the other sections of this Policy. This section describes your CPRA rights and explains how to exercise them. The CPRA and, as a result, this section of the Policy, apply broadly to information collected not only online, but offline as well.  Please note, however, that the CPRA does not apply to certain categories of personal information and our processing of CPRA-exempt categories of information is not addressed below.

Retention of Personal Information

We will retain each category of personal information we collect for the time period required to fulfill the legitimate business purposes for which it was collected and to engage in the disclosure, sale, or sharing practices outlined in this notice, unless a different retention period is required by applicable law, or to otherwise fulfill a legal oblgaition or protect our legal rights. At this time, we do not retain precise geolocation information for any time period.

 

Right to Know and Data Portability

You have the right to request that Weather Champs disclose certain information to you about our collection, use, disclosure and sale of your personal information. Once we receive and confirm your request, to the extent you have requested them, we will disclose to you:

  • The categories of personal information we collected about you;

  • The categories of sources from which your personal information was collected;

  • Our business or commercial purpose for collecting, selling, or sharing your personal information;

  • The categories of third parties to whom we disclosed, sold, or shared your personal information, if any;

  • The categories of personal information we have disclosed, sold, or shared about you; and

  • The specific pieces of personal information we have collected about you (also called a data portability request).

 

Right to Correct

You have the right to request that Weather Champs correct any inaccurate personal information we have collected and maintain about you.

 

Right to Delete

You have the right to request that Weather Champs delete any of the personal information we have collected and maintain about you, subject to certain exceptions. Once we receive and confirm your request, we will either delete, de-identify, or aggregate your personal information, unless not doing so is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, take actions reasonably anticipated within the context of our business relationship with you, or otherwise perform our contract with you.

  • Help to ensure security and integrity to the extent the use of your personal information is reasonably necessary and proportionate for those purposes.

  • Debug products to identify and repair errors that impair existing intended functionality.

  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

  • Engage in public or peer-reviewed scientific, historical, or statistical research that confirms or adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the ability to complete such research, if you have previously provided informed consent.

  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us and compatible with the context in which you provided the information.

  • Comply with a legal obligation.

  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

 

Exercising Your Rights to Know, Correct, and Delete

To exercise your rights to know, correct, and delete under the CPRA please submit a request by emailing us at support@weatherchamps.app.

 

Only you, or someone legally authorized to act on your behalf (i.e., your authorized agent), may make a request related to your personal information. Weather Champs may require an agent to provide verification that they are acting on your behalf when they submit a request related to your personal information. 

 

All requests to know or delete (whether made by you or an authorized agent) must (1) provide sufficient information for us to reasonably verify you by providing two to three pieces of personal information which we will match with personal information we maintain in our records, and (2) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

 

Right to Opt-Out of Sale or Sharing

If you are age 18 or older, you have the right to direct us not to sell or share your personal information at any time (known as, the right to opt-out). We do not collect or sell or share the personal information of consumers we actually know are less than 18 years old.

 

Exercising Your Right to Opt-Out of Sale or Sharing

To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by clicking here 

Alternatively, you may submit an opt-out request by emailing us at support@weatherchamps.app. Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales or sharing.

 

Right to Non-Discrimination

Weather Champs will not discriminate against you for exercising any of your CPRA rights. Unless permitted by the CPRA, we will not:

  • Deny you services;

  • Charge you different prices or rates for services, including through granting discounts or other benefits, or imposing penalties;

  • Provide you a different level or quality of services; or

  • Suggest that you may receive a different price or rate for services or a different level or quality of services.

 

Notice of Financial Incentive

We may offer you certain financial incentives permitted by the CPRA that can result in different prices, rates, or quality levels. Any CPRA-permitted financial incentive we offer will reasonably relate to your personal information’s value. You may stop participating in a financial incentive program at any time. We currently provide the following features, which may be considered financial incentives under the CPRA:

  • Users who complete the optional portion of their user profile will earn in-app currency called a forecast coin which, in future versions of our App, may be used to make purchases. The additional personal information provided by a user, such as the user’s first and last name, is valuable to us because we can share it with our advertising partners in exchange for a fee. Users opt-in to this financial incentive by providing optional profile information. Users may withdraw from this financial incentive at any time by deleting the optional profile information, and any in-app currency earned up until the point of withdrawal, will remain on the account.

  • Users who have purchased a subscription will automatically have dynamic ads turned off in the App. We are able to turn off dynamic ads for paying users because their subscription fee offsets the advertising revenue we would otherwise make from dynamic ads displayed on their profile. When you become a subscribing user, you opt-in to this financial incentive. If you stop paying for your account, dynamic ads will be turned on.

 

Virginia Residents: Your Rights

Virginia residents (“you” or “your” for purposes of this “Virginia Residents: Your Rights” section) have specific rights regarding your personal information under the Virginia Consumer Data Privacy Act (“VCDPA”).

 

Your Rights

You have the following rights:

  • To know whether we collect your personal information;

  • To access the personal information we collect about you;

  • To correct any inaccuracies in the personal information we collect about you;

  • To delete the personal information we collect about you;

  • To obtain a portable copy of the personal information we collect about you;

  • To opt-out of the processing of your data for purposes of (i) targeted advertising, (ii) the sale of your personal information, or (iii) automated processing of your personal information for purposes of predicting your behavior; and

  • To appeal any decision we may make in regard to your consumer request.
